1.) ACCEPTANCE

When the customer orders from the web store, they acknowledges to know the particular terms of sale mentioned on the page and accepts them unreservedly. The hereby general terms of sale govern the contractual relations between CulinaryCookware and the customer. They are applicable in particular to the terms of order, of payment, of delivery and of the control of the possible returns of products ordered by the customer.

2.) PRODUCTS AND NON STICK WARRANTY

The photographs and the texts describing the products are not part of the contractual field. In case of presence of mistakes, they shall not engage the responsibility of CulinaryCookware. The customer always has the ability to get in touch with CulinaryCookware to get additional information on the products presented by sending us a message.

These are not display products, these are commercial working products, some of which are hand crafted (copperware etc.) – as a result, imperfections that do not affect the correct function of the item are not unexpected or grounds for return or replacement.

Most of the products sold by CulinaryCookware to its’ customers are available in stock. The availability of the products indicated on the site is only indicative. In case they are temporarily out of stock, we will tell you the expected delay of supplying the ordered product and we will ship the backordered item once restocked at no additional shippiing charge. (Continental USA only)

NON STICK COATED PRODUCTS - LIMITED WARRANTY - The manufacturer warranties all non stick products against material and workmanship for a period of 90 days after proof of purchase. The warranty is voided if abrasive cleaners, steel wool, bleach, scouring pads or metal utensils are used. NEVER preheat or leave the product on flame or heat when empty as this will damage the surface and void the warranty.
3.) ORDER

An acknowledgement of receipt confirming your order will be automatically e-mailed to you. CulinaryCookware reserves the right to cancel any order of a customer with whom there has been a dispute concerning a prior order. Any information given by the customer when ordering binds him; CulinaryCookware shall not be held for responsible for the consequences of mistakes concerning the wording of the details of the consignee of the products or of the debtor of the order.

4.) PAYMENT

Items must be paid in full the day of the order. The order validated by the customer will be considered effective when the authorized banking payment centre send their acceptance. In case of refusal from the centre, the order will be cancelled.

Online payment by credit card:

The banking information related to the customer (card numbers or expiring dates) are coded by the SSL system and then treated by our financial partners, Moneris and PayPal Therefore buying an item with the CulinaryCookware site is completely safe. CulinaryCookware has no record of or access to your credit card information.

5.) PRICING AND BILLING

The prices indicated in the order confirmation by the company CulinaryCookware include the prices of products, expressed in U.S Dollars and are current at the time of the transaction as well as the expenses of packaging and transport except where otherwise stated, requests for expedited, special services or non Continental USA shipping is subject to additional charges. For countries outside Canada, sales are made without tax.

6.) DELIVERY

Place and delay:

The delivery of our products is carried by our partner carriers in all countries served. The products are delivered at the address of delivery indicated by the customer on his/her order form. If the customer is absent, a delivery notification from the carrier will be placed in the mailbox and will invite the customer to get in touch with the carrier to arrange a later delivery of the parcel or to pick it up at the nearest carriers office.

 Delivery by the Courier services:

The parcels are delivered between 3 and 10 days for any order made before 2 pm Eastern Standard, on the condition that the products are available. The possible delays shall not grant the customer the right to claim CulinaryCookware for damages. In all cases, delivery on time can occur only if the buyer is up to date in his obligations towards the seller. It is agreed to consider as events of "Force Majeure" relieving CulinaryCookware from its delivery liabilities: wars, riots, fires, strikes, accidents, and the impossibilities to be supplied or any other causes that are not under the control of the seller.

7.) CANCELLATION

Orders may only be cancelled in writing either by fax or email.  

Orders that have already been shipped may not be cancelled.

Refusal of shipped orders or return of shipped orders for any reason will be subject to the RETURNS AND REFUND POLICY

Suppliers warehouse and ship all orders, as a result it is the supplier who dictates the return policy and has final right of refusal on all return issues. Claims of damage, defect or error must be made within 48 hours after receiving your order. Claims of freight damaged items must be made to the freight carrier. We will be happy to assist you in making your claim. Returns of non-defective items must be made within 10 days after receiving the items, in its original packaging, unused and in saleable condition. A restocking fee of 30%-50% will be charged. Defective items will be repaired or replaced at the suppliers discretion. Used equipment is not returnable. Shipping costs (the cost to ship the item(s) regardless of any discounted or free shipping offers) are not refundable. Small order fees are not refundable.. Special order, electric machines and discontinued items are NOT returnable. For other items please check with us BEFORE ordering to determine if item is returnable. A Return Authorization (RA) number must be obtained prior to returning any item, and return freight prepaid by the customer. Return shipping instructions will be provided. No returns will be accepted after 15 days. Credit card refunds will be processed to the original credit card

CulinaryCookware is very concerned about your privacy. Our shopping cart uses SSL technology which encrypts your personal information, including your credit card data and prevents it from being intercepted over the Internet. We will never sell or share your personal information, including your e-mail address, to other companies for any reason, except as required by law. Our shopping cart uses cookies to keep track of your stay at our store. The cookie does not gather information from your computer or profile your system. The cookie just tracks your purchase. That's all it does! If you don't feel comfortable sending your credit card information over the Internet or if you just don't want to accept any cookies, you can click the "I'd Rather Have You Call Me For My Card Number" button on the check out form. The shopping cart check out form is the only place on our site that we collect personal information about you. We use a third party for credit card processing, verification and in some cases, to drop ship merchandise. The information does not pass through the site CulinaryCookware. Moneris and PayPal, alone, have access to the information. CulinaryCookware has chosen the SSL (Secure Socket Layer) system used by today's leading e-businesses.

11.) PCI COMPLIANCE
